Terms of Service
DRAFT, pending Christopher's review. This is not legal advice and it is not in effect until that review is done.
Kickoff, a Tinker & Scribe product. These terms are a contract with Tinker and Scribe Workshop Inc., 1146 Route 895, Elgin, NB E4Z 2M3. Questions: chris@tinkerandscribe.com.
The service
Kickoff is software. Clubs, schools, and associations use it to run a season: accounts, registration, rosters, the schedule, RSVP, fields, and a facility calendar. Tinker and Scribe Workshop Inc. provides the software. Kickoff is not a soccer club, not a bank, and not the merchant for parent registration fees.
Accounts
You need an account to use the signed-in parts of Kickoff. Account holders are adults, 19 or older (the age of majority in New Brunswick). Players are roster records entered by a club or parent. They are not accounts. You are responsible for the email and password on that account, and for what people you invite do with the access you give them. An organization admin decides who is a coach, a parent, or another admin. Kickoff may suspend an account that breaks these terms.
Parent registration money
Clubs bring their own Stripe account through Stripe Connect. When a parent pays a registration fee online, that charge goes to the club's connected Stripe account. Kickoff never holds parent registration money. Kickoff does not take an application fee on those charges. Kickoff only records whether a registration is paid, unpaid, or pending. The club is the merchant for those fees and handles refunds of parent fees on its own Stripe account.
Season plans
Rec Season — CA$349 for one season of up to four months, plus HST. Multi-Division — CA$549, same features as Rec, for clubs running more than one league or division, plus HST. District / Association — a written quote, starting at CA$1,800, plus HST. A two-season bundle is a separate written quote. It is not what the self-serve checkout button charges. The free Facility Calendar is not a season plan: it stays free, with no end date, at 2 sites and 5 pads each.
Rec and Multi are one-time payments. Checkout does not turn on automatic renewal. We charge HST where it applies.
Refunds and cancellation
Email chris@tinkerandscribe.com within 14 days after the Stripe payment and we will refund that season invoice in full, unless a live registration, a roster, or a schedule for that paid season has already been published to families. After that, the season fee is not refunded, except where New Brunswick law requires a refund. Closing an account does not by itself refund a season fee. Parent registration fees are refunded by the club, on the club's own Stripe account. Kickoff never holds that money.
Free Facility Calendar
The Facility Calendar is free on an ongoing basis. There is no time limit and no trial. A club gets 2 sites and 5 pads each, for as long as they use Kickoff. Booking is conflict-aware. Kickoff refuses a time that overlaps a booking already on that pad. Rec, Multi, and District cover everything else. The free calendar is not a paid season plan and it does not expire. More sites or pads are not included. Ask chris@tinkerandscribe.com if you need a larger calendar. There is nothing to refund on the free tier.
Acceptable use
Do not use Kickoff to:
- Break the law, or collect information you have no right to hold.
- Harass a player, parent, coach, or official.
- Upload malware, or try to break into another club's data.
- Send spam, or pretend a message is from a league when it is not.
- Resell the software, or scrape it to build a competing service.
League content (rosters, messages, bookings) belongs to the organization that entered it. You give Tinker and Scribe Workshop Inc. permission to host and display that content so the service can run.
Data and privacy
How Kickoff stores account, household, roster, attendance, message, booking, and paid/unpaid status is in the privacy policy. The organization is the controller for registration and parent payments. Kickoff is the processor. Kickoff is not the merchant.
Liability
Kickoff is provided as available software for volunteer and community programs. Schedules, field bookings, and RSVP lists can be wrong if someone enters them wrong, or if the service is down. To the extent New Brunswick law allows, Tinker and Scribe Workshop Inc. is not liable for indirect or consequential loss (a missed game, a registration fee the club collected, or a double-booked pad caused by the club also using another tool). If we are liable for a paid season, the limit is the amount that organization paid us for Kickoff in the three months before the claim. This limit does not apply to liability the law does not allow us to limit, including injury caused by negligence, and it does not override the Consumer Product Warranty and Liability Act where that Act applies.
Termination
You can stop using Kickoff and delete your own account from Account. We can suspend or end access if these terms are broken, if a bill for a season plan is unpaid, or if we discontinue the service. If we discontinue Kickoff, we will email the account address we have and give a reasonable window to export what the product already lets you export (for example the calendar file). Ending access does not erase the club's duty to pay a season invoice that was already earned, and it does not move parent registration money — Kickoff never held it.
Governing law
These terms are governed by the laws of New Brunswick and the federal laws of Canada that apply there. Disputes are heard in the courts of New Brunswick.
